THE HON’BLE PRIME MINISTER OF INDIA,

 

ON

 

DEMAND FOR EXTENSION OF THE PROVISIONS OF

THE SIXTH SCHEDULE TO THE CONSTITUTION OF INDIA

TO THE TRIBAL AREAS OF MANIPUR

ON THE 30TH OF AUGUST, 2014.

 

Sir,

 

We the following signatories representing the Tribal People and all members of Autonomous District Councils (ADC) of Manipur would like to draw your kind attention to   redress the long standing grievances of the Hill People for sympathetic consideration and prompt action.

 

That, the existing 6(six) Autonomous District Councils in Manipur i.e.( 1) Churachandpur( 2) Chandel (3) Sadar Hills (4) Senapati (5) Ukhrul and (6) Tamenglong were installed in the year 1973 in pursuance of the North Eastern Reorganization Act, 1971 and later subsequently passed as Parliamentary Act called ‘The Manipur(Hill Areas) District Council Act, 1971’. However, the council after functioning for about 16 years, the members realized the meager powers and functions of the deceptive Acts and Rules framed by the Govt of Manipur. Hence, the subsequent Election to the Member of District Council was boycotted from 1989 for want of providing the six(6) ADCs under the Sixth Scheduled Provision of the Indian Constitution. Since then, there was chaos all over the Hills of Manipur due to absence of Local Self Government. The present ambiguous scenario in the Hill Tribal Areas of Manipur is the result of negligence of the areas in all fronts of developments, be it economical, political and social wherein the tribal people have been seriously deprived of our rights by the majority community of the Manipur valley.

 

The present Autonomous District Councils in Manipur thatsans autonomy was installed on the 26th June, 2010 after a gap of twenty one(21) years of defunct (1989-2010). Since then, we have been sincerely functioning with the hope that after twenty years of absence of Local Self Governance the aspiration of the tribal people would be realized. However, to our utter disappointment the state Government fail to devolve the enlisted POWERS to the Council even after functioning for more than four(4) out of five(5) years term of the council. The State Govt. had conducted the Election to Members of District Council as per The Manipur(Hill Areas) District Council, Third(3rd) Amendment Act, 2008 wherein POWER to 26(twenty six) subjects were enlisted under Section 29 in sub-section (1) of the principal Act ( Enclosed as Annexure A ). However, more than half of the subject has not been devolved till date even though the Govt. issued order to this effect (Enclosed as Annexure B). Further, no Rules corresponding to the Act of 2008 in regards to Finance, Power and functions etc. were frame till today. The Vice Chairman(one) and the Executive Members(five numbers) of the Council were appointed as per the Amended Act of 2008, however they remained like mere members as there is no corresponding Rules on Powers & Functions.

 

That, the Autonomous District Council members having tasted the insincerity of the Government of Manipur, observed that the State has failed to address the plight of the tribal people of the Hill Areas in all walks of life. Hence, the ADC members of Churachandpur in its Sitting on dated 26/6/2013, Resolution No. 9  have decided to place demand for Extension of Sixth Scheduled Provision of the Constitution to the Hill Areas of Manipur against the existing 6(six) ADCs which read as, The members deliberated on the provision under which the District Councils are functioning. The members expressed their dissatisfaction over the state of devolution of powers and after three years of experience in running the Autonomous District Council, it was felt that the present provisions are insufficient to meet the expectation of the people and to safeguard the land of the indigenous people. Hence, it was unanimously resolved to press the Government for the extension of the provisions of the Sixth Schedule of the Constitution of India to the Autonomous District Council at the earliest” (Annexure C )

 

That, all Tribal Areas in the whole of the North Eastern State such as Mizoram, Meghalaya, Assam and Tripura had been Extended to the Sixth Scheduled Provision to safeguard the interest, customs and culture of the tribal. The Hill Areas of Manipur is the only Tribal Areas in the North East India which is unattended to and unjustly left out from extension of the Sixth Schedule Provision to the Constitution of India. It may also be pertinent to mention here that, when the Bill for Extension of Sixth Scheduled Provision for Tripura Autonomous District was discussed in the LokSabha on 23/08/1984 and in the RajyaSabha on 25/08/1984 the then Minister of Home Affairs Shri P.V. Narasimha Rao assured the House that “Provision of the Sixth Schedule to the Constitution may also be extended to the State of Manipur at the earliest opportunity” (LS & RS debate Extract enclosed as Annexure D).

 

That, the demand for implementation of Sixth Schedule Provision to the Hill Areas of Manipur is not a new issue but pending solution for more than four decades. Three successive Govt. at the State had adopted resolutions for its implementation based on the recommendation of the Hill Areas Committee(HAC)(a copy of Memo submitted to PM by HAC is enclosed as Annexure –E), however, the issue was kept in abeyance by the State Govt. inspite of many reminders. The chronology of decision adopted by the State Govt. and reminders from the Central are as below :

 

  1. On 15/03/1978 the Hill Areas Committee(HAC) passed a resolution for Extension of Sixth Schedule Provision to the tribal Hill Areas of Manipur with Shri S. ADANI, Chairman, HAC in the Chair ( Enclosed Extract copy of Resolution as Annexure-I ).
  2. On 08/06/1983 the HAC re-affirmed the last resolution passed on 15/03/1978 for Extension of the Sixth Schedule of the Constitution of India in the tribal Areas of Manipur with Shri L.S. JOHN, Chairman, HAC in the Chair (Enclosed Extract copy                      of  Resolution as Annexure – II ).
  3. On 18/07/1990 the HAC again re-affirmed the previous resolution adopted in regards to extension of the Sixth Schedule Provision to the present District Council of Manipur with Shri I.D. DIJUANANG, Chairman, HAC in the chair ( Enclosed Extract copy of Resolution as Annexure – III ).
  4. On 13/05/1991 at 11:00 AM the Manipur Cabinet Meeting resolved to recommend the extension of Sixth Schedule in the Hill Areas of the State with certain local adjustments and amendments with Shri R.K. RANBIR SINGH, Chief Minister, Manipur in the Chair (Enclosed Extract of meeting proceeding as Annexure IV).
  5. On 17/08/1992 at 9:30 AM the Manipur Cabinet Meeting again resolved to recommend to the Government of India for extension of the Sixth Schedule to the Hill Areas of Manipur with Shri R.K. DORENDRA SINGH, Chief Minister, Manipur in the Chair (Enclosed extract of Meeting proceeding as Annexure – V).
  6. On 28/03/2001 at 5:00 PM the Manipur Cabinet for the third time resolved that it has no objection to the extension of Sixth Schedule of the Indian Constitution to the Tribal Areas in the Hill Districts of Manipur with certain local adjustments and amendments with Shri RADHABINOD KOIJAM, Chief Minister, Manipur in the Chair (Enclosed extract copy of meeting proceeding as Annexure – VI).
  7. On 22/04/2002 the Hill Areas Committee resolved to request the State Cabinet, Govt. of Manipur to delete the words “ with certain local adjustments and amendments “ from the previous cabinet decision and hence intimate the decision so taken by the HAC to the concerned Minister of Home Affairs, Govt of India, withShri SONGCHINKHUP, Chairman, HAC in the Chair ( Enclosed extract copy of meeting  proceeding as Annexure – VII).
  8. On 06/08/2002 Shri SURENDRA KUMAR  Joint Secretary, Ministry of Home Affairs Hadwritten a letter to the Chief Secretary, Govt. of Manipur as reminder to the previous D.O. letter of even number dated 14/03/2002 and subsequent reminder dated 17/05/2002 and 20/06/2001 regarding extension of the Sixth Schedule to the Indian Constitution in the tribal Areas of Manipur.
  9. On 07/04/2003 the then Deputy Prime Minister of India Shri L.K. ADVANIJI wrote D.O. letter No. 11012/41/2001-NE.IV addressed to Shri O. IBOBI SINGH, Chief Minister of Manipur seeking details from the state Govt regarding the term local adjustments and amendments’ to be made while conferring Sixth Schedule status to the Hill Areas of Manipur(Enclosed as Annexure – VIII).

 

That, inspite of many reminders sent to the Govt of Manipur to clarify in detail the meaning of ‘local adjustment and amendment’ the State fails to gives any tangible reply to the Central Govt. In fact, the State Govt / Majority Community inhabiting only 10 % of the Geographical areas of the state is keen on grasping as much Hill Land of the Tribal areas as possible by way of making various kinds of rules, amendments of acts such as Chief’s Right Acquisition Act of 1967; MLR & LR Act of 1960 and 1967 (Amended to extend to the Hill areas) to suit their ulterior policy. This is the main reason as to why the Govt of Manipur was very keen on inserting the irrelevant term ‘with certain local adjustments and amendments’ in the Sixth Schedule Provision to the Constitution of India.

 

However, the State Govt have achieved their motive clandestinely such that no more ‘ local adjustments and amendments’ is further required for extension of the Sixth Schedule Provisions to the Hill Areas of Manipur as cited below :

 

  1. On 18/12/1984 the State Govt had acquired 17 Hill Villages which are situated within the geographical boundaries of the Hill Districts to the Valley Districts (Enclosed as Annexure IX).
  2. Many numbers of Hill Villages in the Tribal Areas which lie within the jurisdiction of the Autonomous District Council Constituencies had been clandestinely transferred to Valley District by  the Govt of Manipur. To cite just one hill district for instance, the Commissioner (Revenue)issued an Orders dated 24/04/2013 for transfer of Land record  maintained by DeputyCommissioner(DC) of Bishnupur(Valley) District to DC Churachandpur for Computerizations of Land records. However, the DC Bishnupur denied the presence of land record of Churachandpur District with him where as there were 134 villages whose Land Records were with the DC Bishnupur (Enclosed as Annexure X ).

 

That, we feel proud to be called Indian while persevering to be content with the meager welfare accorded to, and then strive for our own survival at all level of livelihood to be at par with others so as to make contribution to our great multi ethnic country sans infrastructures and modern facilities in the Hill Areas. However, it pained our heart to experience alienation, racial discrimination, deprivation and subjugation against our welfare - politically, economically and socially not only in our home state Manipur but also outside the state. Though, thousand and one memorandum have been submitted to the State as well as to the Central Govt. to redressed our grievances, unfortunately all these prayer have so far remained unnoticed. This has generated discontentment and resulted in developing a  sense of foreignism and alienage to the general tribal populace.  

 

Lastly, we wholeheartedly appreciate and congratulate the overwhelming victory and public mandate secured by the BJP in the last 16thLokSabha Election. we, the Tribal people of Manipur believed that the new BJP led NDA Government who had always stood for the cause of the Tribal and weaker section of the society by creating new states such as Uttarakhand, Chhatisgarh and Jharkhand would surely do in the same vein for extension of the  Sixth Scheduled Provision to the Indian Constitution against the Pseudo Autonomous District Council of Manipur Hill Areas.
